Terms of Service

1. Acceptance of Terms

By installing the Swoop Chrome extension or using swooptabs.com, you agree to be bound by these Terms of Service. If you don't agree, please don't install Swoop or use the site. If you're using Swoop on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Swoop is a browser extension that organizes your tabs by intent using a three-tier classification pipeline. The free tier runs fully on your device and never transmits your browsing data unless you choose to spend one of the AI credits a free account includes. Paid tiers (Pro, Premium) add AI-powered tab classification and topic detection via our backend, which processes tab metadata (title, domain, and the page address with its query string and fragment removed) only — never page content.

3. Subscriptions & Billing

Swoop offers three plans:

• Free — €0, forever. Local tab classification only.
• Pro — €2.99/month (or €29.90/year). Includes 100 AI actions/day, shared across AI classification and topic detection. Your 100 actions are counted over a rolling 24-hour period that begins with your first AI action and resets 24 hours later — not at midnight.
• Premium — €8.99/month (or €89.90/year). Includes 250 AI actions/day (shared across AI features), the best AI model, and priority support. Your 250 actions are counted over a rolling 24-hour period that begins with your first AI action and resets 24 hours later — not at midnight.

Paid plans start with a 7-day free trial. You can cancel anytime during the trial at no charge. Payments are processed by Stripe; we never see or store your card details. You can manage your subscription, update payment methods, or cancel from the Stripe Customer Portal linked from the Swoop popup. Refunds are not offered for partial months.

4. Right of withdrawal

If you are a consumer in the EU, the EEA or the UK, you have the right to withdraw from your subscription within 14 days without giving any reason.

When the 14 days start. The withdrawal period expires 14 days from the day the contract is concluded — the day you complete checkout. It does not start when you are first charged. With the 7-day free trial that means your first payment is taken on day 8 and the withdrawal period closes on day 14, six days later.

How to withdraw. Tell us by an unequivocal statement — an email to hello@swooptabs.com is enough. You may use the model withdrawal form, but you do not have to — the page has a button that opens a pre-filled email for you. We will acknowledge receipt by email without delay. To meet the deadline it is enough to send your statement before the period expires.

Effects of withdrawal. We will reimburse all payments received from you without undue delay, and in any event within 14 days of being told, using the same means of payment you used — you will not be charged any fee for the reimbursement.

If you asked us to start straight away. A subscription gives you access immediately, so at checkout we ask you to expressly request that we begin providing the service during the withdrawal period. If you made that request and then withdraw, you must pay an amount in proportion to what was provided up to the moment you told us, measured against the full price of the contract. In practice: we keep a pro-rata share for the days you had access and refund the rest. Nothing is payable for days covered by the free trial, because nothing was charged for them — so withdrawing during the trial costs you nothing at all.

Withdrawing is not the same as cancelling, and it is not the same as deleting your account. Cancelling (from the billing portal) ends the subscription at the end of the period you have paid for. Deleting your account erases your data and cancels billing immediately, but it is not by itself a statement of withdrawal — if you want to withdraw, tell us so.

5. User Accounts

You can sign in with Google OAuth or an email magic link via Supabase Auth. You're responsible for keeping your account secure — don't share your sign-in credentials, and notify us if you suspect unauthorized access. We reserve the right to suspend accounts that show signs of abuse or shared use across multiple people.

6. Acceptable Use

When using Swoop, you agree not to:

• Reverse engineer, decompile, or extract proprietary parts of the service (including the classification pipeline and backend logic)
• Circumvent rate limits, authentication, or metered usage caps
• Use Swoop to process tabs for bulk automation, scraping, or other users at scale
• Resell, sublicense, or distribute Swoop without written permission

7. Intellectual Property

The Swoop name, logo, extension, website, and backend code are owned by David Hlaváček. You get a personal, non-exclusive, non-transferable license to use Swoop while your account is in good standing. That license ends if you cancel or if we terminate your account. You retain ownership of everything in your browser — we claim no rights to your tabs, bookmarks, history, or page content.

8. Disclaimer of Warranties

Swoop is provided "as is" without warranties of any kind, express or implied. We don't guarantee the service will be uninterrupted, bug-free, secure, or meet your specific needs. AI classification is probabilistic — it will sometimes be wrong, and you're responsible for reviewing results. We offer no SLA for uptime or data durability.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of Swoop is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect, incidental, consequential, or punitive damages, including lost data, lost productivity, or business interruption. Some jurisdictions don't allow these limits, so they may not apply to you.

10. Termination

You can cancel your subscription anytime from the Stripe Customer Portal — your access to paid features continues until the end of the billing period. You can uninstall the extension anytime. We may suspend or terminate your account for violations of these terms, with notice where reasonable. You can delete your account yourself at any time from Swoop's Settings (Danger zone), which erases your data from our live systems immediately and cancels any active subscription. Retention after deletion — including backups and the billing records our payment provider must keep — is described in the Privacy Policy.

11. Changes to Terms

We may update these terms from time to time. For material changes (new fees, substantial restrictions), we'll notify you at least 30 days in advance via email or an in-extension notice. Continued use after changes take effect means you accept the updated terms.

12. Governing Law

These terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. Any disputes will be resolved in the courts of the Czech Republic. If you're a consumer in the EU, nothing in these terms limits your mandatory consumer rights under the law of your country of residence.
